General Terms and Conditions (GTC) – Nik-Werk

1. Scope
These General Terms and Conditions apply to all contracts, services, and offers in the fields of translation, language and cultural mediation, and publishing provided by Nik-Werk, both online and offline.

2. Conclusion of Contract
A contract is concluded upon written confirmation of the offer, acceptance by email, or commencement of service. Verbal agreements must be confirmed in writing.

3. Scope of Services
The exact scope of services is defined in the respective offer or contract. Changes or additions require written agreement. For translations, a meaningful and professionally accurate rendering of the source text is owed, not a literal translation.

4. Client Obligations
The client agrees to provide all necessary information, texts, and materials in a timely and complete manner. Delays due to missing input may result in postponed delivery dates.

5. Fees and Payment Terms
Fees are based on the agreed rate. Unless otherwise stated, invoices are payable within 14 days of receipt without deduction. In case of late payment, reminder fees and interest may be charged.

6. Liability
Nik-Werk performs all services with the utmost care and to the best of its knowledge. However, no guarantee can be given for absolute accuracy or completeness – especially in the case of complex or ambiguous source texts.
Liability for damages is assumed within the scope of statutory provisions. No liability is accepted for minor negligence, indirect damages, or loss of profit. In cases of gross negligence or intent, Nik-Werk is liable as provided by law.
Nik-Werk is covered by legal protection insurance with AXA, ensuring professional legal representation in case of disputes. This insurance protects Nik-Werk’s legal interests but does not imply extended liability toward clients.

7. Copyright and Usage Rights
Copyrights for created texts, translations, or editorial content remain with Nik-Werk, unless otherwise agreed. The client may use the content only within the agreed scope of rights.

8. Confidentiality and Data Protection
All transmitted content and personal data are treated confidentially and processed in accordance with applicable data protection laws (FADP, GDPR). Disclosure to third parties occurs only with legal basis or consent.

9. Use of Artificial Intelligence (AI)
AI-based tools (e.g. machine translation, text analysis) may be used for certain projects. Nik-Werk ensures compliance with data protection standards and transparency. No automated decisions with legal effect are made.

10. Withdrawal and Cancellation
Withdrawal from the contract is only possible before the start of service. In case of short-term cancellation, partial costs for work already performed or reserved capacities may be charged.

11. Jurisdiction and Applicable Law
Swiss law shall apply. The place of jurisdiction is Winterthur, unless mandatory legal provisions stipulate otherwise.

12. Copyright and Author Protection
All content submitted by clients, authors, or third parties is subject to copyright. Nik-Werk undertakes to respect these rights and use the content solely within the agreed scope of services.
Disclosure, publication, or editing of such content occurs only with the explicit consent of the rights holders. For translations and editorial work, the original copyright remains with the author unless otherwise agreed.

Nik-Werk respects the interests of authors and translators, particularly regarding attribution, archiving, and publication. Reference use is permitted only with prior consent or in anonymized form.
